PUBLIC HEARING NOTICE

The City of Laurel will conduct a public hearing on March 12, 2024, for the operation of MoCones on Laurel School District property located at 203 East 8th Street.  Full Legal description of the property is MORRIS SUBD 1ST FILING, S09, T02 S, R24 E, BLOCK 7, Lot 12 - 22, & LTS 11-20 BLK 8, & LTS 1-30 BLK 9 & S150' LTS 5-8 BLK 10, LTS 1-20 BLK 11 MORRIS SUB 2ND & COS 434,335; S150'COS'S 439,339,233;COS'S 448,235,576 LESS N180' & TRS 1B & 1C COS 361 AMD (10)

The current zoning is P “Public” and state law allows for public agencies to use public lands contrary to local zoning regulations if a public hearing is held, and the Laurel School Board attends the hearing. MCA 76-2-402.

76-2-402. Local zoning regulations -- application to agencies. (1) Whenever an agency proposes to use public land contrary to local zoning regulations, a public hearing must be held and the agency shall attend the public hearing.

(2) The local governing body shall hold a hearing within 30 days of the date the agency gives notice to the local governing body of its intent to develop land contrary to local zoning regulations.

The hearing is scheduled for 6:30 P.M., in the Laurel City Council Chambers at City Hall, 115 West 1st Street, Laurel, Montana, on Tuesday March 12, 2024.

The Laurel City Council will not take any action for or against the Laurel School Board’s decision to let MoCones operate on public lands.

Public comment is encouraged and can be provided in person at the public hearing on March 12, 2024.  Public comments can also be made via email to the Planning Director, or via letter to the Planning Department office at 115 West 1st Street Laurel, MT 59044.  Emails or letters of comments should be received by 2pm MST March 7, 2024, so they can be transmitted to the City Council.  The Laurel School Board’s resolution is available for review upon request at the Planning Department office.
